01Acceptance of Terms

• By installing or using PerkStack, you agree to be bound by these Terms of Service.
• You must be authorized to act on behalf of the Shopify store on which PerkStack is installed.
• Your use of PerkStack is also subject to Shopify’s Terms of Service, which you must comply with at all times.

02Description of Service

• PerkStack provides loyalty rewards, product reviews, and referral program tools designed for Shopify merchants.
• Features and usage limits vary by plan: Free, Growth, and Pro. Plan details are available on our pricing page.
• We may update, modify, or add features over time. Significant changes will be communicated in advance.

03Account and Access

• PerkStack is accessed through your Shopify admin as an embedded application. No separate account is required.
• You are responsible for all activity that occurs under your Shopify store’s use of PerkStack.
• We reserve the right to suspend or terminate access to accounts that violate these terms.

04Acceptable Use

• Do not use PerkStack for any illegal, harmful, or unauthorized purpose.
• Do not attempt to reverse engineer, decompile, or exploit the service or its infrastructure.
• Do not abuse the loyalty or referral system through fraudulent activity, fake accounts, or manufactured transactions.
• Do not violate Shopify’s Terms of Service or Acceptable Use Policy while using PerkStack.

05Billing and Payments

• All billing is handled securely through Shopify’s billing system. We do not process payments directly.
• A free plan is available with standard usage limits.
• Paid plans (Growth and Pro) are billed monthly through your Shopify account.
• A 7-day free trial is available on paid plans so you can evaluate the full feature set.
• You may cancel your subscription at any time through the Shopify admin.

06Intellectual Property

• PerkStack, including its design, code, features, and documentation, is our intellectual property.
• Your store data, customer information, and business content remain your property at all times.
• Review content is owned by the reviewer, with a license granted to the merchant for display and marketing purposes.

07Limitation of Liability

• PerkStack is provided on an “as is” and “as available” basis without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
• Our total aggregate liability is limited to the fees you have paid to PerkStack in the 12 months preceding the claim.

08Service Availability

• We aim for 99.9% uptime but do not guarantee uninterrupted or error-free service.
• Scheduled maintenance windows will be communicated in advance whenever possible.
• We are not responsible for outages or disruptions caused by the Shopify platform or third-party services.

09Termination

• Either party may terminate this agreement at any time by uninstalling the app or notifying the other party.
• Upon termination, we will delete your data within 30 days in accordance with our Privacy Policy.
• Sections relating to intellectual property, limitation of liability, and governing law survive termination.

10Governing Law

• These terms are governed by the laws of the jurisdiction in which PerkStack operates.
• Any disputes will be resolved through good-faith negotiation before pursuing formal proceedings.
